Terms of service
Effective date: 17 October 2026
1. About these terms
These terms govern the use of the Ondine website at https://ondine.omniteca.it and of the Ondine creator (together, the “Service”), provided by Omniteca Lab di Nicolazzo G., Via Montegrappa 25, 73040 Alliste (LE), Italy, VAT IT04466720754 (“Omniteca Lab”, “we”, “us”).
By using the Service you accept these terms. If you register an account, you are asked to accept them explicitly. If you do not agree, please do not use the Service.
2. The Service
Ondine offers free online tools to design ebook and book covers (Ebook Cover) and images for social networks (Storytelling). The Service is provided free of charge, on an “as is” and “as available” basis.
We may change, suspend or discontinue the Service, or any part of it, at any time and without notice, for example to update it, for technical or security reasons, or because we decide to stop offering it.
3. Accounts
You must be at least 18 years old to register an account and use the creator. When you register, you must give a valid email address that belongs to you. Each account is personal and may not be transferred.
You are responsible for keeping your password secret and for all activity on your account. Tell us at once at info@omniteca.it if you think someone else has accessed it.
4. Acceptable use
You agree not to use the Service to:
- upload, create or share content that is unlawful, defamatory, obscene, hateful, violent, harassing, that harms minors or that violates the privacy or the rights of others;
- infringe copyrights, trademarks or any other right of third parties;
- upload viruses or other harmful code, or try to access accounts, data or systems without authorisation;
- overload, disrupt or interfere with the Service, or access it with automated means other than a normal web browser;
- resell, rent or offer the Service itself, or access to it, to third parties.
We may remove any content that violates these terms or the law, and suspend or close the accounts involved.
5. Your uploads and your designs
Your uploads. You are solely responsible for any image, text or other material you upload to or use in the creator. By uploading it you confirm that you own it or have all the rights, licences and permissions needed to use it, and that it does not infringe any copyright, trademark, image, privacy or other right of any third party.
Your designs. The covers and images you create and export (“Designs”) may be used by you for personal and commercial purposes, including the publication and sale of books and ebooks and the promotion of your activities. You are solely responsible for your Designs, for their content and for any use you make of them, including checking that they meet the requirements of the stores, platforms and social networks where you publish them.
What we may do with them. Your uploads and Designs remain yours. You allow us to store, process and display them only as needed to provide the Service to you (for example to save your work, create previews and let you export it), and as described in section 7 for the templates you choose to make public.
6. Graphics library
Backgrounds, images, shapes, textures, fonts and templates made available in the creator (the “Library”) are provided “as is”, solely as an aid for creating your Designs. Some items are provided by third parties and may be subject to their own licences or attribution requirements.
We give no warranty that any item of the Library is free of third-party rights or suitable for any particular use. Before publishing or selling a Design, it is your sole responsibility to check that the items it contains may be used for that purpose, and to obtain any licence that may be required. You may use Library items only as part of your Designs: you may not extract, redistribute or sell them separately.
7. Public templates
If you choose to make one of your Designs public as a template, you grant Omniteca Lab and the other users of the creator a free, worldwide, non-exclusive licence to view, open, modify and use it as a starting point for their own Designs. You may make a template private again at any time; Designs already created by other users from it are not affected. We may review, refuse or remove public templates at our discretion.
8. Storage and availability
We do our best to keep the Service working and your work saved, but we do not guarantee that the Service will be available without interruptions or errors, nor that saved Designs, uploads and exports will be kept. They may be lost or deleted, for example in case of technical problems, inactivity of the account or discontinuance of the Service. Always keep your own copy of every exported Design.
9. Our rights
The Service, its software, the Library, the contents of this website and the Ondine and Omniteca Lab names and logos belong to Omniteca Lab or to its licensors. Except for the use of your Designs described in section 5, these terms do not give you any right on them. You may not copy, modify or reverse engineer the software of the Service.
10. Copyright complaints
If you believe that content available through the Service infringes your rights, write to info@omniteca.it with your contact details, a description of the protected work, the address of the content you are reporting and a statement that the information you give is accurate and that you are the owner of the rights or are authorised to act on their behalf. We will examine the report and remove the content where appropriate.
11. Closing your account
You may stop using the Service at any time and ask us to delete your account by writing to info@omniteca.it from the email address of the account.
We may suspend or close an account, with or without notice, if it violates these terms or the law, if we are required to by an authority, if it remains unused for a long period, or if we discontinue the Service. When an account is closed, the Designs and uploads associated with it may be deleted.
12. No warranty
The Service is free and is provided “as is” and “as available”. To the maximum extent permitted by applicable law, Omniteca Lab gives no warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy or absence of errors.
13. Limitation of liability
To the maximum extent permitted by applicable law, Omniteca Lab shall not be liable for any damage, direct or indirect, arising from the use of, or the inability to use, the Service, the Library or your Designs, including loss of data, of Designs, of profits or of business opportunities, and damages arising from claims of third parties concerning your uploads or Designs.
Nothing in these terms excludes or limits our liability for willful misconduct or gross negligence, or in any other case where liability cannot be excluded or limited by law.
14. Indemnity
You agree to indemnify and hold harmless Omniteca Lab from any claim, demand, loss, damage, cost or expense, including reasonable legal fees, made by any third party or authority and arising from your uploads, your Designs, your use of the Library or of the Service, or your violation of these terms or of the rights of others.
15. Third-party services and links
The Service uses some third-party services (for example Google Fonts in the creator and YouTube for the video tutorials) and contains links to other websites. We are not responsible for their content, availability or practices.
16. Privacy
How we handle your personal data is explained in the privacy policy.
17. Changes to these terms
We may update these terms, for example when the Service changes. The new version is published on this page with its effective date. If you continue to use the Service after an update, you accept the new terms; if you do not agree, you may stop using the Service and ask us to delete your account.
18. Governing law and jurisdiction
These terms are governed by Italian law. If you are a consumer, you keep the protection granted to you by the mandatory rules of the country where you live, and any dispute will be decided by the court provided for by the applicable consumer law. In all other cases, the court of Lecce (Italy) has exclusive jurisdiction.
19. General
If any provision of these terms is found invalid, the other provisions remain in force. Our failure to enforce a provision is not a waiver of it. These terms, together with the privacy policy, are the entire agreement between you and Omniteca Lab concerning the Service and replace any previous version.
